These Terms of Service ("Terms") govern your use of the VPS hosting services, websites, and related products provided by YourBudgetHosting Inc. ("Company", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.
By creating an account, purchasing a service, or otherwise accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, you must not use our services.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised Terms.
YourBudgetHosting provides Virtual Private Server (VPS) hosting services, including but not limited to:
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to affected customers.
To use our services, you must create an account and provide accurate, complete, and current registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to create an account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our infrastructure. Prohibited activities include but are not limited to:
Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
Services are billed on a recurring basis (monthly or annually) depending on the plan selected. Payment is due at the beginning of each billing cycle. All prices are listed in US dollars and are exclusive of any applicable taxes.
If payment fails, we will attempt to charge your payment method again. If payment is not received within 7 days of the due date, we reserve the right to suspend your services. Services suspended for non-payment for more than 14 days may be terminated and all data permanently deleted.
We offer a 30-day money-back guarantee for all new VPS hosting accounts. If you are not satisfied with our service within the first 30 days, you may request a full refund by contacting our support team. This guarantee applies only to the initial billing period of new accounts.
Refunds are not available for: renewal payments, add-on services (additional IP addresses, licenses), domain registrations, or accounts terminated for Terms of Service violations.
We guarantee 99.9% network uptime for standard VPS plans and 99.99% for cloud VPS plans. If we fail to meet the applicable SLA in any calendar month, you may be eligible for service credits. Full SLA details are available on our SLA page.
While we provide backup services as described in your plan, you acknowledge that you are ultimately responsible for maintaining copies of your data. We strongly recommend maintaining independent backups of all critical data. We shall not be held liable for any loss of data due to hardware failure, software issues, or any other circumstances.
To the maximum extent permitted by applicable law, YourBudgetHosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use our services.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
You may cancel your services at any time through your control panel or by contacting support. Upon cancellation, your service will remain active until the end of the current billing period.
We reserve the right to terminate or suspend your account immediately, without prior notice, if you violate these Terms or the Acceptable Use Policy. Upon termination, we may permanently delete your data after a 7-day grace period.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in San Francisco County, California.
